Here's something you might not expect patent consultants to say: Not every innovation needs a patent.
At Enovo, we regularly review companies' IP strategies and often find businesses rushing to patent everything they develop. This approach wastes money and dilutes focus from what truly matters.
Let's be clear about when patents make sense - and when they don't:
Trade secrets might theoretically be better for certain innovations, but it's important to note that India currently lacks formal trade secret protection. While a trade secret bill is in the works, this protection avenue remains limited in our country for now. However, even without formal protection, companies must carefully consider whether patent disclosure makes strategic sense for processes or formulas that competitors can't easily reverse-engineer from the final product.
Cost-benefit analysis matters too. Patents require significant investment - not just filing fees, but maintenance costs over 20 years, potential litigation expenses, and international filings if your market extends beyond India. For some innovations, especially those with short market lifecycles or minimal competitive advantage, the math simply doesn't work out.
Market positioning is another consideration. Patents make sense when they align with your business strategy. Are you planning to license your technology? Do you need patents to attract investors? Will competitors be blocked from significant market opportunities? If not, you might be better investing those resources elsewhere.
Speed to market can sometimes outweigh patent protection. In fast-evolving industries, establishing market leadership and brand recognition might provide better protection than waiting for patents.
